Courts rule Nuisance is a State Matter ---- Mass Nuisance Lawsuit Settled
FAA is an organization of General Aviation pilots tasked with policing, among other things, General Aviation. FAA has become corrupted due to this conflict of interest. We are finding the same pattern of lies and abuse across this nation. If you've ever heard "But where will they fly?", then you know what we are talking about.
This institutionalized misconduct renders FAA incapable of fulfilling its regulatory duties to the public. We will tell that story here.
FAA Regional Counsel Brags He Won't Enforce Regulation
The very people we hire to regulate and rein in the aviators are themselves pilots. They are loathe to interfere with their fellow pilots ability to fly about without a care. They have lost site of their mission to regulate. In the case of the inspectors and the regional counsel, they have lost sight of the fact that they are the hired help. They are not hired to make policy, but to be an instrument of policy. The regulations exist. They must go out each day and enforce them. Instead they abuse their offices and attempt to govern autocratically. Chris Poreda, the regional counsel for the New England Region, typifies this attitude. We caught up to Mr. Poreda at a meeting of the Worcester Area Pilots Association (WAPA) on 07 Oct 2004. The meeting was open to the public and was jointly sponsored by FAA and WAPA. When asked about Temporary Flight Restrictions implemented by the Department of Homeland Security, Mr. Poreda stated he would not enforce them. Listen Here.
The problem extends to the Office of the Inspector General
On 21 March 2005, William Burgoyne, president of STOP the NOISE, sent a complaint to Inspector Scott Harding of the Department of Transportation's Office of the Inspector General. This complaint detailed abuses of office and dereliction of duty by multiple members of the New England Regional Office and the Lexington FSDO. This complaint contained enough evidence to get the OIG started and reported that there was more evidence and more witnesses waiting to be contacted by the OIG. After 16 months of supposed 'investigation', during which they would not provide a status report, the OIG responded that they had "directed the Federal Aviation Administration to conduct an inquiry into your allegations. Your allegations were not substantiated." The Inspector General had FAA investigate itself on a complaint regarding institutionalized corruption. The words that come to mind are stupidity, arrogance, collusion, and corruption. Clearly these matters require an independent investigation from outside the organization, perhaps from outside the government.
Rather than clutter this page with links to all the individual documents, I will provide one link to the complaint letter, and one to a zip file containing all the documents submitted with the complaint. Enjoy.
